General Terms and Conditions (GTC)

Ginger & Django GmbH – Premium Dog Daycare
As of: September 30, 2025

1. Scope 

These General Terms and Conditions (GTC) apply to all dog care services provided by Ginger & Django GmbH, Friedrich-Panzer-Weg 2C, 81739 Munich (hereinafter referred to as the “Provider”) to customers. By booking or using our services, the customer accepts these GTC in their current version. Before concluding a contract or registering, the customer must confirm that they have read and accept the terms and conditions by ticking a box.

2. Scope of Services

The Provider operates a professional dog daycare with a comprehensive educational and conceptual care program. This includes, among other things:

  • Structured daily routines with phases of rest and activity
  • Indoor play areas including agility courses
  • Walks (guided and adapted to dog type and group composition)
  • Creative activities such as scent work and pet-friendly painting
  • Group or individual care depending on social behavior and need

These services are included in the care price unless otherwise agreed. Specialized services such as medical care or grooming are provided exclusively by external partners and are organized and billed separately.

There is no entitlement to specific activities; the staff determines the daily schedule based on the group composition, health status, and individual needs of the dogs.

3. Requirements for Care

Only the following dogs are admitted:

  • Dogs with a maximum shoulder height of 50 cm
  • Dogs with complete and valid vaccination records (proof required)
  • Dogs with existing pet owner liability insurance
  • Dogs that are not classified as dangerous according to BayLStVG

The dog’s health must be ensured at every visit. The Provider reserves the right to refuse or immediately require the pickup of dogs showing visible signs of illness or parasites (e.g., fleas).

Our facility is designed for the safe care and supervision of small and medium-sized dogs. The restriction to dogs with a maximum shoulder height of 50 cm ensures compliance with the regulations of the local veterinary office, corresponds to our available space, and our staff-to-dog ratio. This policy protects the welfare of the animals, ensures operational safety for all guests, and meets the requirements for licensed dog daycare centers in Munich.

4. Booking, Availability & Cancellation

Bookings are made via digital channels (e.g., Calendly) or by email. Phone calls are for informational purposes only and do not constitute binding bookings.

Care Capacity:
In the event of unforeseeable restrictions (e.g., staff shortages due to illness), the provider may be forced to limit the number of dogs cared for at short notice. In this case, affected booking(s) will either be refunded or a free rebooking will be offered within four weeks of the originally booked date.

Cancellation & Rescheduling Policies:
Subscription customers (ongoing care package): Do not need to cancel individual missed days. Unused days expire and are not refunded. Subscription customers can reschedule individual booked days up to 1 hour before start time at no charge. Later rescheduling is only possible if capacity allows.

Single bookings (no subscription): Free cancellation is possible up to 24 hours before care begins. After that, the full price is charged.

Closure/Force Majeure:
In the event of force majeure or significant operational disruptions (such as pandemics, war, or official closure orders), the provider is entitled to temporarily suspend operations. In such cases, customers will not be charged for days on which care cannot be provided. Payments for the affected periods will be refunded or credited toward future services at the provider’s discretion.

5. Prices, Payment Terms & Penalties

Prices are listed on the website and shared during initial contact. A one-time registration fee of €175 is due at the first registration, which includes a welcome package.

Payment Methods:
Cash & card payment on-site, or bank transfer.

Invoicing and Payment Deadlines:
Invoices are issued monthly. Payment deadline: by the 15th of the following month.

Penalty Process:
If payment has not been received by the 16th, an initial reminder will be sent informing the customer of the late fee of €8 that is now payable. If the invoice is still not paid, a second reminder will be sent at the end of the month. At this point, the invoice amount, the late fee of €8, plus the statutory default interest will be invoiced. If payment is still not made, the claim will be handed over to the responsible legal representative for further enforcement.

Delay:
If payment is still outstanding at the end of the following month, the case will be handed over to the provider’s legal representative or the relevant debt collection/insurance unit. Further communication and enforcement of the claim will be handled exclusively by the appointed agency. In this case, the provider will no longer accept direct payments. 

6. Liability and Insurance

Participation is at the owner’s own risk. The owner is liable for any damage caused by the dog (to people, dogs, or property) under their pet owner liability insurance.

The provider is not liable for injuries or illnesses caused by dogs to each other, unless the staff has acted with gross negligence or intent.

If the required dog liability insurance expires or becomes invalid, or if vaccinations have expired, care of the dog will be suspended with immediate effect. Care may only be resumed after presentation of valid insurance confirmation and current vaccination records, and is at the discretion of Ginger & Django GmbH.

7. Conduct & Exclusion

Aggressive or problematic behavior (e.g., biting incidents, uncontrollable behavior) may result in immediate exclusion. This decision is at the sole discretion of the caregiving staff.

Dogs are only supervised under direct care. Assignment to group or individual care is determined by the staff based on the dog’s size and temperament.

8. Health Management

The owner is obligated to disclose and update all relevant health information and vaccination status.

In case of health issues, parasite infestations, or behavioral abnormalities, a dog may be excluded from care for at least 24 hours. Return is only allowed after clearance from the caregiving staff.

9. Photos and Social Media

Photos and videos of the dogs may be used for internal communication and marketing purposes (e.g., social media, website), unless the owner has expressly objected. Consent is given via a consent form during registration.

10. Data Protection

The collection, processing, and storage of personal data is carried out in accordance with the applicable General Data Protection Regulation (GDPR) and national laws. The core data processed includes name, address, contact details, and information about the dog that is necessary for the fulfillment of the contract. 11. Contract Duration, Termination, and Single Bookings

Contracts may be terminated by either party in writing or text form (e.g., email) with a signature.

Subscription customers: One-month notice period to the end of a month. Changes to subscription models can be made at short notice if capacity allows.

Single bookings are subject to the same conditions as outlined in section 4: free cancellation is possible up to 24 hours before care begins. After that, the full price is charged. Rescheduling is only possible after consultation and subject to capacity.

Termination by the Provider:
The Provider may terminate the contractual relationship with immediate effect in the event of serious breaches after internal review and management approval. These include, but are not limited to:

  • Repeated non-payment despite reminders
  • Aggressive or dangerous behavior of the dog
  • Violations of mandatory vaccination requirements or contractual terms
  • Disrespectful, insulting, or aggressive behavior toward staff

The latter applies particularly to severe incidents such as verbal abuse, threats, or inappropriate behavior that permanently damage the relationship of trust. Such termination is only made after internal review and approval by management. Re-enrollment in the care program is only possible after two years and with the explicit consent of the Provider.

12. Jurisdiction

The place of jurisdiction for all disputes, where legally permissible, is Munich.

13. Severability Clause

If individual provisions of these GTC are or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision.
